We should abolish the department and host nothing other than the chair of the President, Vice-President, Secretary of State, and Senators. There's a possibility we can keep one position open beneath the Secretary of State which would be Licensing Officials. They'd be assigned to either the Business Licensing Department or the Weapon Licensing Department and would handle applications, license seizures and so on before a chair opens vacant for their promotion.   5. *San Andreas Government* Public Relations Secretariat House I. Introduction: San Andreas Senate is the sole legislative body of the state of San Andreas. Senate was established, protected, and empowered by San Andreas Constitution. Senate makes and enacts laws or constitutional amendments in the form of a public discussion and voting among senators. Citizens of San Andreas can voice their opinion via senators during a law-making discussion. II. Terms: As defined in San Andreas Constitution, senators serve terms of three (3) months each. III. Citizen Participation: The sheer number of people in the state of San Andreas will make discussions and forums very difficult to manage and reach a compromise if everyone were to given the access to a discussion. Senate was made so that people's opinion are organized by a senator and collectively represented during a discussion. Within this smaller group, discussions can proceed with a speedy manor while retaining people's opinion. Even though citizens might feel distanced from the government by this medium known as Senate and that they are not directly communicating in a law-making process, citizens are still encouraged to actively participate by contacting senators with your concern and your opinion. We do not want you to be discouraged from participating in shaping your state's law and policy. There are two ways citizens can actively participate in shaping political policies: Elections and communicating with senators. Election: At the very end of each senatorial term, elections will be hosted to elect new senators. It is the most direct way which a citizen influence the government. Election is not limited to selecting new senators! San Andreas Constitution Article IV Section 7 empowers citizens to start a recall election to remove senators. However, you must reach 60 votes in 10 days and an opposing senator must be chosen during the recall election. Communicating with senators: Senate is where additions, deletions, and amendments to laws and the constitution happens. Senate is always open for public to view. As a citizen you have the rights to contact your senator and exert your idea and opinion in an ongoing bill. It is senators' duty to reflect your will onto those discussions. If you feel like your senator is not representing your will, you can always start a recall election mentioned above. IV. Recall Election: San Andreas Constitution Article IV, Section 7 provides every citizen the right to recall a senator. A petition can be started at anytime within our website. SEC. 7. The process of recalling elected legislative officials is as follows: (a) A petition with the sole intent to recall the official must reach 60 valid signatures in the period of 10 days. (b) An opposing candidate must be chosen by the electorate through a recall primary. (c) A recall election between the recall candidate and the public official being recalled will occur, the winner of a plurality in this election will assume the contested office. V. Passing Legislation: The Legislative Branch of the San Andreas Government is tasked with voting on laws that will effect the entire State. For a bill that is introduced to the Senate floor to be passed into law it must go through the following process. 1. 1 week discussion period where Senator places their votes on the bill within that time period. If the bill fails to get a majority of the yes votes by Senators the bill will be rejected 2. The Bill passes a majority vote by the Senate and it will be presented to the President where he can sign it into law or Veto the bill. 3. The President has signed the bill or has not chosen to veto it within the 12-day period so the bill is now law and in San Andreas. SEC. 4. (a) Each bill passed by the Legislature shall be presented to the President. It becomes a statute if it is signed by the President. The President may veto it by returning it with any objections to the house of origin, which shall enter the objections in the journal and proceed to reconsider it. If each house then passes the bill by roll call vote entered in the journal, two-thirds of the membership concurring, it becomes a statute. In many states, the duties of Vice-President are increased by legislation to include the vice-president on state boards, commissions and task forces. " Prime Minister In most of the individual states of the United States, the Prime Minister of State is an administrative officer responsible for certain governmental functions. The specific powers and duties of this office depend on the constitution and laws of the particular state, but they often include responsibility for overseeing elections within the state. Senator As a legislative branch of government, a legislature generally performs state duties for a state in the same way that the United States Congress performs national duties at the national level. Generally, the same system of checks and balances that exists at the Federal level also exists between the state legislature, the state executive officer (governor) and the state judiciary, though the degree to which this is so varies from one state to the next. Judicial Department/DoJ Chief Justice The Chief Justice is the highest judicial officer in the state, and acts as a chief administrative officer for the state courts. The Chief Justice also serves as a spokesperson for the judicial branch. The Chief Justice leads the business of the Supreme Court and presides over oral arguments. When the court renders an opinion, the Chief Justice—when in the majority—decides who writes the court's opinion. The Chief Justice also has significant agenda-setting power over the court's meetings. Associate Justice Associate Justice is the title for a member of a judicial panel with the Chief Justice, Judicial panels are non-hierarchical, so an Associate Judge has the same responsibilities with respect to cases as the Chief Judge. State Attorney General The Attorney General is the State Attorney General of San Andreas. The officer's duty is to ensure that "the laws of the state are uniformly and adequately enforced" The Attorney General carries out the responsibilities of the office through the San Andreas Department of Justice. Their duties include; As the state’s chief law officer, ensures that the laws of the state are uniformly and adequately enforced. Heads the Department of Justice, which is responsible for providing state legal services and support for local law enforcement. Acts as the chief counsel in state litigation. Oversees law enforcement agencies, including District Attorneys and Sheriffs. Federal Magistrate The magistrate judge's seat is not a separate court; the authority that a magistrate judge exercises is the jurisdiction of the district court itself, delegated to the magistrate judge by the district judges of the court under governing statutory authority, local rules of court, or court orders. Rather than fixing the duties of magistrate judges nationwide, the Federal Magistrates Act allows each district court to assign duties to the magistrate judges as fits the needs of that court. In criminal proceedings, magistrate judges preside over misdemeanor and petty offense cases, and as to all criminal cases (felony and misdemeanor) may issue search warrants, arrest warrants, and summonses, accept criminal complaints, conduct initial appearance proceedings and detention hearings, set bail or other conditions of release or detention, hold preliminary hearings and examinations, administer oaths, conduct extradition proceedings, and conduct evidentiary hearings on motions to suppress evidence in felony cases for issuance of reports and recommendations to the district judge. The Supreme Court has held in Peretz v. United States that magistrate judges may supervise the jury selection in a felony trial unless a party objects. In civil proceedings, magistrate judges typically manage discovery and other pretrial matters. They are authorized to issue orders in pretrial matters as long as the order is not dispositive of the case as a whole (such as an order granting summary judgment). They may also be assigned to write reports and recommendations to the district judge as to dispositive matters. With the consent of the parties, they may adjudicate civil cases in the same manner as a district judge, including presiding over jury or non-jury trials. State District Judge State courts handle the vast majority of civil and criminal cases in the state. District Attorney The District Attorney (DA) represents the state government in the prosecution of criminal offenses, and is the chief law enforcement officer and legal officer of that state's jurisdiction. The prosecution is the legal party responsible for presenting the case against an individual who is suspected of breaking the law, initiating and directing further criminal investigations, guiding and recommending the sentencing of offenders, and are the only attorneys allowed to participate in grand jury proceedings. The District Attorney supervises a staff of prosecutors, Assistant District Attorneys (ADAs), who represent the State and prosecute criminals on behalf of the District Attorney. Depending upon the system in place, DAs may be appointed by the chief executive of the jurisdiction or elected by the voters of the jurisdiction. Public Defender Public defender is a lawyer appointed to represent people who cannot afford to hire an attorney. The 1963 US Supreme Court case Gideon v. Wainwright held that the Sixth Amendment's right to counsel provision requires the government to provide legal counsel to indigent defendants in criminal cases. Legal Investigator The justice system is dependent on cold, hard evidence. Legal investigators are the professionals called upon to ensure that both prosecuting and defense attorneys have all pertinent information, including records, documents, and witness testimony, at their disposal when making their case, whether in civil or criminal courts. All information and evidence must advance legal theories so as to benefit their client’s case. Due to time constraints, lawyers often rely on a team of professionals to gather the information and documents needed for the case, with legal investigators being an integral part of that team. Legal investigators perform a number of essential duties for both defense and prosecuting teams, all of which require a sharp mind, solid researching skills, excellent oral and written communication skills, and astute investigative skills.   9. *SAN ANDREAS GOVERNMENT* Public Relations Secretariat House RECRUITMENT INFORMATION [1.0] Requirements The requirements of the San Andreas Government Department are straightforward and simple to achieve. To join the department you must first meet the requirements set by the Human Resources Division. Before applying for the government department, applicants must first make sure that the recruitment status is OPEN before sending in any applications. If you send an application whilst recruitment is still CLOSED You will be denied instantly. If it is clear in your application, you have given no effort then you will be automatically denied from the department. [1.1] Applicant Requirements Before applying, you should consult this list of requirements and make sure you’re ready to go through the recruitment process. You must be at-least 21 years of age before submitting your application. You mustn't have a major criminal record. You must have the ability to drive a motor-vehicle and hold a valid driver’s license. You must be physically and mentally fit for the job. You must be able to speak and write fluently in the English language. If an applicant has recently been fired from the government department, they are required to wait 14 days before re-applying to the department. If you re-apply before this time frame has passed, you may be faction banned from the department. If an applicant has been banned from the department, they may apply for a ban-appeal 14 days after the date of their ban. Once they have been unbanned they must wait an additional 7 days before applying to the department with an application. If you have been banned from the department, regardless of any previous rank you may have held - you will have to go through the recruitment process as everyone else should. If you have been denied, you must wait a further 7 days before attempting to re-apply, overlooking this policy will result in you being banned. [1.2] (( Out of Character Requirements )) You must be atleast level 5 before applying for the faction. You must be able to speak and type fluently in English. You must have the ability to role-play to a high standard. You must apply as your main character, we do not accept alt(ernate) accounts. You must not get admin prisoned or banned during the time your application is up. You must have a good OOC reputation, and not be known as a troll/rulebreaker. You must use your main forum account to create the application, or it will be denied instantly. You must list all the past names the applying character has used, failure to do so results in a Departmental Ban. NOTE: If you were recently fired/resigned from a faction, you must wait 7 days to apply, we won't be setting applications on hold anymore. Applying before will get your application instantly denied. [2.0] Applications When you are applying for the San Andreas Government Department, ensure that your VSPAG (Vocabulary, Spelling, Punctuation and Grammar) is correct for the most part and that you have written your application to the best of your ability. (( Remember to list your character's previous names. Also list your past characters, including any CKed ones. )) Once your application has been reviewed, do not constantly harass a member of the Human Resources division’s members as this may result in your application being denied - you can only ask one member of the Human Resources division to process your application if it has not been replied to within the past 24 hours. [2.1] Reinstatements The following criteria now applies for Reinstatements: You must have an active Employee profile or have evidence that you were an Officer or higher within the past 6 months OR you must have achieved Senetor or higher, or served the department for 2 weeks+. You may also reinstate if you were in a Municipal or State Assembly faction other than Government in the past 1 months, with valid evidence. You must have a valid firearm license. If you have been an Politician or higher before 2 months of applying, you may have to start over as a bodyguard. If you were terminated or faction banned (and then unbanned in an appeal), you will have to start over as a bodyguard regardless of your former rank. If you were charged for any misdemeanors or felonies since your last resignation (will be reviewed during Dirty Background Check), you will be forced to start over as a Bodyguard. [2.2] Plagiarism and Error Check Once you have submitted your application, the Recruitment Officer who reviews your application will first cross-check your application details with various other applications, both from Government Archives as well as other factions. Make sure you have not plagiarized any details from other archived applications or you can get Faction Banned. If your application has any misplaced information, doesn't meet word limit, has many errors in the Vocabulary/Grammar or doesn't have proper documents uploaded then it is set to CORRECTIONS. You then have 72 hours to fix the mentioned errors. [2.3] Background Check Once your application has been reviewed, recruitment officers will process your name through the database to check your criminal record and set your application to Pending Background Check. Once this has been enforced, the scenarios listed below will be taken into account. Felonies and Misdemeanors - If you have between 1-3 felonies or 1-7 misdemeanors, your application will be set to Pending State Government Recommendations. You will then require a majority vote among the State Government team. If you have more felonies/misdemeanors than the defined limit, your application will be denied instantly. If there are multiple charges of both types present, 3 misdemeanors will be equated to 1 felony. [2.4] Pending Interview Once your application clear the background check, your application will then be set to Pending. At this point, you are to contact a Human Resources recruiter and wait for them to call you over to the station. At no point are you allowed to harass any recruiter, as this can result in an instant denial. Depending on the outcome of the interview, you can then be Reinstated, Denied or Accepted. [3.0] Department Interview and Post-Interview [3.1] Department Interview As stated above, when your application is on Pending, you are to contact a Human Resources recruiter and they'll arrange an interview time for you. At the allocated time, you are to head to the office where the recruiter will ask for your ID and want to fully frisk you for any potential illegal items. You are to comply with the recruiter and if everything checks out, he will then take you to a closed room for the interview session. During this session, the interviewer will ask you various questions and study your body language. He will deem whether or not you're fit for the department, both physically and mentally. If you manage to clear this stage, you may then be Reinstated or Accepted. The Handbook knowledge test is no longer a part of the Interview. (( Be sure to connect to the NL:RP Teamspeak server so that the Interviewer can test your general communication skills. )) [3.1] Post-Interview If you were Reinstated into the department, you'll be given a brief summary of your assigned duties and any changes that have happened in the Government since you were last in it. After this, you are to resume said assigned duties. If you were Accepted as a fresh Bodyguard, you will then be transferred over to a Human Resources political traninng for a course that lasts 1-2 hours. During this course, you will be given a copy of the SAPD manual to read over. You will then be taught the basics of being a Cadet, what duties you are allowed and not allowed to do .etc. After the end of the course, you will be given a small exam and if you manage to clear it, you will then be permitted to the 7 day Academy course. All citizens are required to abide by these laws. Law enforcement officers are here to enforce the law, meaning that they're still required to follow it as well. The State Penal Code is divided in Titles, Sections and Subsections. Example of this: Title 1, Section 3, Subsection 02 (T-1,(3),02) Law enforcement officers are required to follow all the regulations stated by the penal code. When charging civilians, a LEO must: Correctly spell the charge. Calculate the total time a person will spend in jail or prison. Must NOT stack the same charge multiple times. Failure to follow these regulations will result in serious consequences. T-1(1)01 is a misdemeanor which can get you a maximum of 10 minute(s) in a local jail. (1)02 - BATTERY Battery is defined as a use of physical force against another individual which results in serious harm or damages upon the person. T-1(1)02 is a misdemeanor which can get you a maximum of 15 minute(s) in a local jail. (1)03 - ASSAULT WITH A DEADLY WEAPON Assault with a deadly weapon is defined as use of any tool or equipment during a physical attack on another individual. 'Presidential Office', such proposal of Mr.Henry Brusca was been denied upon the instructions directed by the Honourabl'e Presidential Crown Mr.Vijay Joshi. On further of such denial to such proposal that Mr.Henry Brusca started thereating, the Presidential Crown to pass the proposal pursed under his lustful desires. In the on going of the same transaction he committed an offence of defarmation and Contempt of the Hon.'Presidental Crown'. (c) An abstained vote shall be counted as the absence of a vote. (d) A bill can not be passed before the 7 day discussion frame unless all Senators have given their vote. SEC. 9. In the event of a tie in a Senate Vote the Lt. Governor should provide the tie breaking Vote. Article V: Judicial Branch SEC. 1. The judicial power of this State is vested in the Court of San Andreas. SEC. 2. The Court of San Andreas consists of the Chief Justice of San Andreas and 4 associate justices. The Chief Justice may convene the court at any time. Concurrence of 3 justices, Chief or associates, present at the argument is necessary for a judgment. An acting Chief Justice shall perform all functions of the Chief Justice when the Chief Justice is absent or unable to act. The Chief Justice or, if the Chief Justice fails to do so, the court shall select an associate justice as acting Chief Justice. SEC. 3. (a) Judicial appointments of associate justices are conducted by the Chief Justice. Also he killed Kareem Chambers as well twice without any reason below are given evidences as well. I have no clue why he did that, but he DMed + KOS which i know is a collaborating evidence to punnish him. Has your driving license ever been suspended?: No Life Story(Minimum 250 words): I was born in 1992/01/01 at 05:22 my mother gave birth to me at All Saints general hospital at the MNC clinic. When I was 6 my mother passed away in a car accident unfortunately, that left me to myself due to that my father left my mother a few months after my birth. I had two younger brothers and one sister but I've never seen them. When I was 6 I was put into a foster care and I had difficulties adjusting to the new environment at first but that changed after a few months living with them. They raised me as one of their own kids they treated me well and was helping me out a lot with the struggle I've been through. My foster dad had a cousin that was a professor at the University of Los Santos. I was with him a few days watching him work and that saw what astonishing work he had accomplished with different criminal incidents. That made me think that I'd like to become a FBI Agent. At the age of 15 he took me in as his youngest recruit ever and started teaching me the basics of the criminology and that elaborated quickly I started to read about the proclaimed offenders on a cellular level and I was sent into a whole new world. I studied for 5 years straight and graduated as a regular Law student with the specialty of Law & Crimes. After that, I read 3 more years to become a Police Officer and that went successfully. I started working for a Los Santos Police Department after my graduation.On my way in the working with Los Santos Police Department i like to expand the possibilities of my skills,experience,talents & knowledge which i have gained in the past years so now as per my aspirations and motivation i got from my proffessor i decided to place my steps towards the higher authoritative department that is FBI. Tell us about yourself and why you want to be in the FBI(IC):(Minimum 200 words) I am applying for this 'FBI Department' because I wish to serve and protect the city with my life. A good citizen must try to develop and serve his country to make it great and the best way to do it directly is to become an employer within the FBI Department. If I join the FBI Department, I would discharge my heart and soul to this job. The city is an one big nasty place and the people of the city is not safe anywhere. And the protection of the citizen is valuable. I want to be a part of the FBI Department and help the fellow citizens, as well as to protect them with my life. I don't care about my life, my first priority is to protect the people of the city and I can assure that. I will do anything to protect them. And if you want to ensure the citizens security, you need trust worthy and loyal officer, and I am one of them. So if I join the FBI Department , it would be a great help to the city and I will be glad to fulfill and discharge my duties perfectly as a fellow people of the city. Also, i have few skills and intelligence which I can contribute to the FBI Department. There are not only one but more then one. Hardworking, trustworthy, loyalty and the ability to get any kind a job done. Firstly, hardworking. I am a really hardworking fellow. To get a job done I'll work for days with zero breaks and distractions. And I won't rest until my job is completely finished. Secondly, trustworthy. Trust is currently very rare in this world. It's hard to trust someone anywhere, anytime. But as for me everyone can trust me with their heart and I will make sure that trust doesn't go away easily. Thirdly, loyalty. As a honest and trust worthy man, I am also a loyal person. Because when someone becomes trustworthy he will truly become a loyal man and that it always comes in handy in the hard time. Finally, pure skill. I have the skill to get any job done as I don't care what is it and how hard it is.
